The recent adoption of the Ecodesign for Sustainable Products Regulation by the European Parliament marks a significant milestone in the EU's journey towards a sustainable future. This regulation, published on 28 June 2024, establishes a comprehensive framework aimed at enhancing the environmental sustainability of products within the European Union. It sets stringent environmental standards for products and introduces mandatory requirements for product design, focusing on increasing the durability, repairability, recyclability, and overall environmental performance of products sold in the EU.
One of the important aspects of the regulation is the mandatory implementation of Digital Product Passports (DPPs) for all products on the EU market. These passports will provide comprehensive information about a product's lifecycle, including its materials, production processes, and environmental impacts. DPPs are expected to enhance traceability, reduce the risk of counterfeiting, and promote informed consumer choices. By linking each DPP to a unique product identifier, the regulation ensures thorough tracking and monitoring across the supply chain. This interoperability with other EU databases, such as the European Product Registry for Energy Labelling (EPREL), further strengthens traceability and accountability.
Data accessibility and security are also key components of the regulation. Information within the DPP must be accessible to all relevant stakeholders, including manufacturers, importers, distributors, and consumers while ensuring the protection of confidential business information and personal data in adherence to EU privacy regulations. This transparency fosters trust among consumers and helps businesses and authorities ensure that products meet high environmental standards, reducing the risk of greenwashing.
The regulation considers the impact on micro, small, and medium-sized enterprises (SMEs), aiming to avoid disproportionate costs by providing specific guidance and support to help them comply with the new requirements. This inclusive approach ensures that SMEs can contribute to and benefit from the shift towards sustainable production and consumption.
Market surveillance and compliance are strengthened through regular and structured exchanges of information between market surveillance authorities and providers of online marketplaces to identify and remove non-compliant products. Provisions for customs controls to verify compliance before products are released for free circulation in the EU market further ensure adherence to the regulation.
In promoting sustainability and the circular economy, the regulation supports production and consumption patterns aligned with the EU’s sustainability targets. It encourages the use of renewable resources and improves repairability, and recyclability of products, ultimately aiming to reduce waste, improve resource efficiency, and increase the recycled content in products.
